Legal Director, Patent Underwriting About the Position Certum Group is a leading litigation finance company and is the only U.S. company that provides both litigation funding and access to litigation insurance. A significant portion of our funding opportunities involve patent infringement disputes. Certum Group has created a Legal Director, Patent Underwriting position to support our fast-growing patent business. The Legal Director will be responsible for diligence on all patent opportunities, including patent litigation funding and patent acquisitions. You will analyze the cases for merits strength, damages, collectability, and other factors that influence litigation risk. You will work cross-functionally with both our funding and insurance teams and you will engage with patent litigation counsel and patent holders seeking funding. If we offer and execute a term sheet on an opportunity, you will liaise with outside diligence counsel to diligence the matter. As part of the underwriting team, you will assist in structuring, executing and closing transactions. You will have exposure to all aspects of our fast-growing, entrepreneurial business. Location This job is remote and may be performed from anywhere in the United States. Residence in New York or Minnesota is preferred. Responsibilities • Analyze and diligence patent opportunities submitted to Certum Group for funding or insurance • Liaise with Certum clients who have submitted matters for funding or insurance • Assist with structuring litigation finance and/or acquisition transactions • Maintain strong, efficient communication with stakeholders within the organization as well as external clients • Keep abreast of developments in patent law, litigation funding, and contingent liability insurance Minimum Qualifications • Law degree from a top U.S. law school • Licensed attorney with at least 7 years of patent litigation experience • Trial and other courtroom experience • Experience working on both the plaintiff- and defense-side • Exceptional teamwork and customer relations skills • Ability to quickly digest claims chart, patents, pleadings, damages theories, etc. to assess strength of patent claims and potential defenses • Ability to assess any/all permutations of IP claims, including risks before PTAB, claim construction issues, merits, and appeal • Creative and decisive thinker willing to make decisions without perfect information • Willing to move from the practice of law to the business of law • Collaborative team player who works well with others • Comfortable working remotely • Keeps up to speed on all big picture developments in patent law • Proven history of working effectively in small team environments Preferred Qualifications • Plaintiff-side contingent fee litigation experience • Experience working with litigation funding • Experience across a range of technical areas • Patent monetization or mining experience • Experience conducting and/or analyzing prior art searches • Experience with non-patent commercial disputes • Appeared as counsel of record in cases pending in well-known U.S. patent venues, including EDTX, WDTX, D. Del. and/or Federal Circuit • Understanding of foreign patent systems, including the UPC, Germany, UK and China • Interest in assisting business development and marketing efforts • Business or financial experience • Proven history of working effectively in small team environments • Help establish team goals for executing patent funding / insurance strategy, measuring progress, and reporting results
