GENERAL DESCRIPTION Performs highly significant and complex investigative and inspection duties for the Texas Medical Board and eight sub-boards and committees. Within the confines of established procedure and policy, independent plans, organizes, schedules and conduct prolonged, complex or unusual investigations through data collection, review and evaluation of documents and medical records, interviews of witnesses, and obtaining appropriate panelists/consultants(s). Independently prepares comprehensive and detailed reports of investigative findings that support case resolution. Works under the direct supervision of the Program Supervisor and subsequent supervision of the Manager of Investigations as needed, with considerable latitude for the use of discretion, initiative, and independent judgment. May be required to exercise discretion and independent judgment with respect to complex and/or unusual investigations and inspections procedures. Duties may include assisting with training. PRINCIPAL JOB DUTIES AND RESPONSIBILITIES 85% Within the confines of established procedure and policy, independent plans, organizes, schedules, and conducts complex investigations and inspections through data collection, review and evaluation of documents and medical records, interviews with witnesses, and obtaining appropriate consultation. Prepares comprehensive and detailed reports of investigative findings in compliance with policy and guidelines for content and timeliness, to include but not limited to adequate support of dismissal or prosecution for case resolution. Independent overnight travel will be required. 5% Initiates and assists with the presentation of evidence in court and administrative hearings; testifies as a witness. 10% Performs related work as assigned REQUIRED EXPERIENCE AND EDUCATION Must hold a Texas License in good standing as a Registered Nurse or Licensed Vocational Nurse and have practiced nursing for a minimum of 4 years. REQUIRED EXPERIENCE AND EDUCATION Graduation from an accredited four-year college or university with major coursework in medicine and health care, medical quality assurance, investigations or related fields of study preferred. Extensive investigative training is preferred. Extensive and responsible experience in direct patient care, investigative, clinical, and medical quality assurance work preferred. KNOWLEDGE, SKILLS, AND ABILITIES Knowledge of Microsoft suite (e.g. Word, PowerPoint, SharePoint, Excel, and Microsoft Teams). Knowledge of federal regulatory laws affecting the practice of medicine and the Texas Medical Board. Knowledge of investigative methods and court procedures, rules of evidence, and departmental policies. Skills in conducting investigations, inspections and/or medical record review - medical peer review. Skills in compiling, evaluating, and presenting relevant data gathered through investigation or review. Skills in preparation of detailed and comprehensive investigative reports. Skills in researching and interpreting rules and regulations. Skills in applying investigative techniques and procedures to assigned cases. Skills in prioritizing tasks, staying organized, and working under strict time constraints. Skills in using independent judgment and working with minimal supervision. Ability to initiate and coordinate all phases of an investigation. Ability to analyze medical records. Ability to identify expert testimony regarding standards of medical care. Ability to communicate effectively both verbally and in writing. Ability to accurately report facts. Ability to gather information and evidence. Ability to explain and interpret pertinent provisions of laws and regulations to other investigators, licensees, and complainants. Ability to maintain productive and professional liaison with co-workers, the public, and federal, state, and local authorities. Ability to work cooperatively with others in case preparation. Must have working knowledge of Microsoft Windows. Must be knowledgeable and familiar with operating document management systems. You must be willing and able to travel independently at least 5% of the time that may require overnight stays. WORK ENVIRONMENT REQUIREMENTS The principal job is performed in a standard in-office or remote environment setting and may require travel to the office in Austin, TX as necessary for meetings or other duties. Regular and punctual attendance Monday - Friday. Must respond to internal and external communications in a timely manner which is at least o Within 72 hrs (3 business days) of when external communication is received o Within 24 hrs (1 business day) of when internal communication is received Within 15 minutes while working remotely during business hrs if contacted by your Manager unless you are on pre-approved leave or on a recognized lunch or exercise break. Frequent use of personal computers, copiers, printers, and telephones. Frequent sitting. Frequently working under deadlines, as a team member, and in direct contact with others Compliance with all agency policies and procedures, including but not limited to applicable confidentiality, security and safety rules, regulations and standards. PHYSICAL REQUIREMENTS AND/OR WORKING CONDITIONS The principal job is performed in a standard office and requires: Reliable and secure high speed internet access with a minimum of 20 MBPS download and 2 MBPS upload. Applicants may be required to provide confirmation from the area ISP. All applicants will have frequent use of keyboard, mouse, and other input devices. All applicants need to have the ability to participate in video calls, phone calls, and virtual meetings. All applicants may experience frequently working under deadlines, individually or as a team member, and at times may collaborate with others to meet deadlines. All applicants may generally experience low physical demands, occasional lifting of equipment up to a certain weight (e.g. 10-40 lbs.). LEGAL REQUIREMENTS In accordance with state law, authorization for telework may not be awarded to an employee as a condition of hiring. A new employee must complete department probationary training period before evaluation for a telework agreement. TMB will conduct a TXDPS criminal history check on all new hires due to access to confidential or sensitive data while performing the work of the position applied for. Cannot hold outside employment that interferes with assigned work schedule, nor does it constitute a conflict of interest with TMB employment and services. Must reside in Texas. Dual employment at another state agency or Texas public university is not permitted.
